Terms and Conditions

1. Products

1.1 All Products on this website (which may vary from time to time) are available in London, UK.
1.2 Certain Products may be delivered in bud to ensure longer life.
1.3 Some Products, Flowers, and Plants may be harmful or poisonous. If you require further information before submitting an order, please contact us using the contact details set out in Section 6 below.
1.4 All Products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute a Product of equivalent value and quality without notice.
1.5 In the event that we are unable to supply the Product or any substitute product to you at all, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full, and in any event no later than 30 days after the intended delivery date.

Within our alcoholic gift range:
1.6.1 We reserve the right to replace brands shown with those of equal value and quality.
1.6.2 Under the Licensing Act of 1964 (UK) and 1976 (Scotland), it is an offence for any person under 18 years to buy, or attempt to buy, alcoholic liquor. It is an offence under Sections 32 and 33 of the Intoxicating Liquor Act 1988 (Ireland) for any person under 18 to buy, or attempt to buy, intoxicating liquor. It is an offence under the Licensing (Northern Ireland) Order 1990 for any person under 18 to buy, or attempt to buy, intoxicating liquor.

2. Prices

2.1 Prices listed within the Service are valid for a maximum of 14 days from submitting your order.
2.2 Prices include VAT.

3. Orders / Payments

3.1 During order submission, you shall be required to provide us with your personal details, including an accurate postcode, together with those of the intended recipient and all necessary payment details. We accept payment by most major credit and debit cards. By clicking on the "Complete Order" button on the Order Form, you consent to be bound by the Terms and Conditions of Janet Edwards Florist Studio, contained herein and elsewhere on the Online Site.
3.2 Submission of your Order Form is subject to acceptance by Janet Edwards Florist Studio. We will not consider ourselves bound by a contract with you unless we have issued a confirmation of order delivery by email. This is not the email sent on submission of an order.
3.3 We cannot accept Order Forms from customers under the age of eighteen (18) years.

4. Delivery

4.1 Our delivery service is only within the London, UK area.
4.2 Upon acceptance of your Order Form, Janet Edwards Florist Studio will advise you by email confirmation of the intended delivery date. Order Forms received on Sundays or Public Holidays will be processed the next working day. We do not deliver on Sundays or public holidays; in such cases, delivery will be made on the next working day.
4.3 Errors or omissions in your submitted personal details may lead to delays or issues with delivery. Please ensure all address details, including accurate postcode and contact information, are correct before placing your order.
4.4 Whilst we will use all reasonable efforts to deliver on the requested date, this cannot be guaranteed. In such cases, you will be notified in advance where possible, and alternative arrangements or a full refund will be offered.
4.5 For deliveries to locations involving third parties (e.g., offices, hospitals, airports, hotels, ships, and other business locations), a signature from an authorized person will be accepted as proof of delivery. Please note we are unable to deliver wines and plants to Funeral Directors, hospitals, airports, or ships.
4.6 We are only responsible for delivery to the address provided (or an immediate neighbour if no one is available). Once delivered, we cannot accept responsibility if the recipient has moved or refuses to return the item(s).
4.7 If no one is available to accept delivery, the carrier may leave the item with a neighbour or leave a card for redelivery instructions.
4.8 You may request a preferred delivery time in the "Delivery Notes" field. This is mainly for funeral deliveries. While we will try to meet this request, it cannot be guaranteed. Orders should be placed at least one working day in advance.
4.9 If delivery issues arise, we reserve the right to contact the recipient using the details provided.
4.10 Additional delivery instructions may be provided in the "Delivery Notes" field. We reserve the right to disregard any instructions deemed unreasonable and rely on the provided address details.

5. Cancellation

5.1 Orders may be amended or cancelled up to 48 hours before the intended delivery date.
5.2 To amend or cancel your order, please contact Janet Edwards Florist Studio using the details in Section 6 below.
5.3 You are entitled to cancel any payment in the event of fraudulent use of your credit or debit card by a third party and will be refunded accordingly if not already reimbursed by the card issuer.

6. Customer Services

6.2 Due to the perishable nature of Products, complaints should be made within 1 working day of delivery or intended delivery.

7. Disclaimer

7.1 While we strive to ensure the Online Site and Service operate correctly, Janet Edwards Florist Studio does not guarantee uninterrupted or error-free functionality and accepts no liability for any disruptions.
7.2
(a) We accept liability for death or personal injury caused by our negligence.
(b) Subject to clause 7.2(a), our liability is limited to three (3) times the price paid for the Products.
(c) We exclude liability for indirect or consequential losses, including loss of profits, data, or business opportunities.
(d) We are not liable for delays or failure caused by circumstances beyond our control.

8. General

8.1 Janet Edwards Florist Studio reserves the right to amend these Terms and Conditions at any time. Changes will be posted on the website and will take effect shortly after posting.
8.2 We may suspend or terminate access to the website at any time.
8.3 If any part of these Terms is deemed invalid, the remaining provisions will continue in effect.
8.4 We comply with applicable data protection laws and will use your data only as outlined in our Privacy Policy.
8.5 Third parties have no rights to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
8.6 These Terms represent the entire agreement between you and Janet Edwards Florist Studio.
8.7 These Terms are governed by English law, and disputes shall be subject to the jurisdiction of English courts.
